A la carte Booking SaaS terms
Version 2026-11-04. These terms apply between [company name], [registered address], Belgium, company number [company number] ("A la carte Booking", "we") and the hotel or hotel company that creates an account ("the hotel", "you").
1. The service
1.1 A la carte Booking is a web application that lets hotel guests book à-la-carte restaurants and activities, shares limited seats fairly, gives staff a reception, host and manager view, and (in the Pulse plan) collects short guest feedback.
1.2 We provide the service "as is" over the internet. We may improve and change features. We will not remove a core feature of your plan during a paid period without giving you at least 30 days' notice and the right to end the subscription with a refund of prepaid fees for the remaining period.
1.3 A la carte Booking never collects money from guests. Paid extras that you enable are charged by the hotel to the room bill through your own systems.
2. Account and trial
2.1 You create the account yourself. The person who signs up confirms that they may bind the hotel.
2.2 New hotels get a free trial of 60 days without a payment card. At the end of the trial the hotel becomes read-only until a plan is chosen. Data of a hotel that does not subscribe is deleted 60 days after the trial ends.
3. Your obligations
3.1 You keep log-in codes and tablet PINs confidential and remove access for staff who leave.
3.2 You are responsible for the content you enter (restaurant texts, photos, menus) and for informing guests about the processing of their data (see the data processing agreement and the guest privacy text in the app).
3.3 You do not use the service to send unsolicited marketing to guests, and you do not try to access data of other hotels.
4. Availability and support
4.1 We aim for 99.5% monthly availability of the guest page, excluding planned maintenance announced at least 24 hours in advance. The host tablet keeps working offline for tonight's list.
4.2 Support is given by e-mail at support@alacartebooking.com in English and German, on business days, and through the help centre.
5. Fees
5.1 Prices are per room in the hotel per month, with a minimum of €250 per month per hotel: Dine & Do €1.20, Dine & Do + Pulse €1.70. Prices exclude VAT.
5.2 Fees are invoiced in EUR in advance per quarter or per year (yearly: 10% discount) and paid by card or SEPA through Stripe.
5.3 We may change prices with 60 days' notice, effective from the next billing period.
6. Payment, VAT and taxes
6.1 Hotels in the EU with a valid VAT number: VAT reverse charge. Hotels outside the EU: no Belgian VAT.
6.2 If a payment is more than two months late, we may set the account to read-only until payment is received. Guests cannot book during that time. Data is not deleted.
6.3 Unpaid amounts bear late interest under the Belgian Act of 2 August 2002 on late payment in commercial transactions.
6.4 All fees are net amounts. If the hotel must withhold any tax on a payment, the hotel pays an additional amount so that we receive the full invoiced amount (gross-up), and gives us the withholding certificate.
7. Term and termination
7.1 A subscription runs for the chosen billing period and renews automatically for the same period, unless it is cancelled in the billing portal before the end of the period.
7.2 Either party may end the agreement with immediate effect if the other party materially breaches it and does not remedy the breach within 30 days of written notice.
7.3 After the end, you can export your data for 30 days. We then delete the hotel's data, except invoices that we must keep by law.
8. Liability
8.1 Our total liability per year is limited to the fees paid by the hotel in the 12 months before the event that caused the damage.
8.2 We are not liable for indirect damage, lost profit, lost reviews or reputation damage, except in case of fraud or wilful misconduct.
9. Data protection
The hotel is the controller of guest personal data and A la carte Booking is the processor. The data processing agreement at /legal/dpa is part of these terms. Data is hosted in the European Union.
10. Law and courts
Belgian law applies. The courts of the judicial district where [company name] has its registered office have exclusive jurisdiction, unless we choose to bring a claim before the courts where the hotel has its seat.
